OSHA Scaffold Requirements: 29 CFR 1926 Subpart L Explained (2026 Guide)
What does OSHA actually require for scaffolds?
Short answer: Scaffolds are governed by 29 CFR 1926 Subpart L. Four numbers carry most of the compliance weight: a scaffold must support 4 times its maximum intended load, fall protection is required above 10 feet, a supported scaffold taller than 4:1 height-to-base must be restrained from tipping, and a competent person must inspect it before every work shift. Get those four right and you have cleared the bulk of what inspectors cite.
Scaffolding sits in an awkward gap on most jobsites. It is not a ladder, so the ladder rules do not apply. It is not a permanent walking-working surface, so the general fall-protection trigger does not apply either. Scaffolds get their own subpart, their own fall-protection height, and their own inspection regime, and the numbers differ from the ones crews recite by habit.

The height that trips everyone up: 10 feet, not 6
The most common scaffold misunderstanding is the fall-protection trigger. On general construction work, when is fall protection required is answered at six feet. On a scaffold it is not.
29 CFR 1926.451(g)(1) states that each employee on a scaffold more than 10 feet above a lower level must be protected from falling to that lower level. That is a scaffold-specific threshold. Crews that apply the six-foot rule to scaffolds are being conservative, which is fine. Crews that carry the scaffold ten-foot rule back to general work at seven feet are exposed.
The protection itself is either a guardrail system or a personal fall arrest system, depending on scaffold type. Capacity: the 4x rule
1926.451(a)(1) requires that each scaffold and scaffold component support, without failure, its own weight plus at least 4 times the maximum intended load.
Read that carefully, because it is a design factor and not a working limit. A scaffold rated at 1,000 pounds is not a scaffold you may load to 4,000 pounds. It means the manufacturer built a 4:1 safety margin against the rated capacity. The number you work to is the rating on the label.
Maximum intended load includes everything the platform carries: workers, tools, materials, and equipment. A two-worker drywall crew with a stack of board and a screw gun reaches a 500-pound platform rating faster than most people estimate.
The 4:1 tipping rule, and why it is not the ladder 4:1 rule
Two different rules on the same jobsite share the same ratio, and conflating them is a genuine hazard.

For supported scaffolds, 1926.451(c)(1) requires that once the height-to-base-width ratio exceeds 4:1, the scaffold is restrained from tipping by guying, tying, bracing, or equivalent means. On the Baker-style towers most interior trades use, the practical answer is outriggers, because they widen the effective base rather than tying you to a structure you may not be permitted to drill.

Planking: full decking and the 1-inch gap
1926.451(b)(1)(i) requires each platform unit to be installed so the space between adjacent units, and between the platform and the uprights, is no more than 1 inch wide.
This is the rule that catches partially planked decks. A gap wide enough to drop a drill through is a gap wide enough to catch a boot. Where the work genuinely requires a wider opening, the standard allows it only if the employer demonstrates the wider space is necessary. That is an exception to document, not a default to assume.
Guardrails on scaffolds: 38 to 45 inches
For supported scaffolds manufactured or placed in service after January 1, 2000, 1926.451(g)(4)(ii) sets the top edge height of toprails between 38 inches and 45 inches.
Note the date qualifier. Scaffolds placed in service before 2000 fall under a different range, which is why a mixed fleet can produce two legitimate answers on the same site. The general guardrail framework is covered in depth in OSHA guardrail requirements.
Inspection: competent person, before every shift
1926.451(f)(3) requires scaffolds and scaffold components to be inspected for visible defects by a competent person, before each work shift, and after any occurrence that could affect structural integrity.
Two phrases there do real work. Competent person is a defined role with authority to take prompt corrective action, not simply the most experienced hand on the crew. Before each work shift means daily, not weekly and not once at erection. If the tower was sound yesterday and something clipped it overnight, the inspection from yesterday is void. Rolling and Baker-style scaffolds: the rules for the tower in your shop
Most crews do not own system scaffolding. They own a Baker-style tower, also sold as Perry-style, and those fall under 1926.452(w).
- Lock the casters before anyone climbs. 1926.452(w)(2) requires casters and wheels to be locked with positive wheel or swivel locks, or equivalent means, to prevent movement while the scaffold is used in a stationary manner.
- Check the surface before you move it. 1926.452(w)(6)(i) requires the surface to be within 3 degrees of level and free of pits, holes, and obstructions.
- Do not ride the tower as routine. Employees may remain aboard during movement only when a specific set of conditions is met, including the level-surface requirement above, outrigger frames installed on both sides, and no employee positioned beyond the wheel supports.
- During movement the ratio tightens to 2:1. 1926.452(w)(6)(ii) limits height-to-base-width to two to one or less while the scaffold is moved, unless it is designed and constructed to meet or exceed nationally recognized stability test requirements.
- Re-inspect after the move. A relocation is an occurrence that can affect structural integrity, which puts you back into 1926.451(f)(3).
The practical takeaway: a 6-foot Baker tower on a level warehouse slab, casters locked and fully planked, is a straightforward compliant setup. The same tower stacked to 12 feet and moved with a worker aboard across an expansion joint is three violations at once.
Worked example: a 6-foot Baker tower in a warehouse
An electrician needs to run conduit at 11 feet in a distribution center. Here is the decision path, rule by rule.
Platform height. A 6-foot Baker-style tower puts the deck near 6 feet, with the hands of the worker reaching roughly 11 to 12 feet. The deck is under 10 feet, so the trigger in 1926.451(g)(1) is not met by height alone. The guardrail system on the tower is part of why that is acceptable, and stripping rails to save time changes the answer. Capacity. One electrician, a tool bag, and a bundle of EMT sits well inside a 1,000-pound rating. Two workers plus a full reel changes the arithmetic. Check the label rather than the memory.
Tipping. A 6-foot deck on a roughly 30-inch base is comfortably inside 4:1. Stack a second frame to reach 12 feet and the ratio crosses the line, triggering 1926.451(c)(1). Add WEN 31104 Baker scaffold outriggers or VEVOR 4-pack scaffold outriggers rather than assuming the base is wide enough.

Does a scaffold need fall protection if it already has guardrails?
