How do you dispose of a fire extinguisher?

Short answer: There is no single federal rule for disposing of a fire extinguisher, and that is the part most guidance gets wrong. A charged extinguisher is a pressurised vessel and does not belong in a bin or a kerbside recycling cart. What you do next depends on two things: whether the unit is rechargeable or disposable, and whether it still holds pressure. Rechargeable units go to a licensed servicing company. Disposable units must be fully discharged and depressurised first, then handled through whatever route your local authority specifies โ€” because EPA leaves pressurised containers to state and local rules.

This guide is for facility managers clearing out failed units after an inspection, and for homeowners who found a twenty-year-old extinguisher in a garage. Why this matters.
An extinguisher that fails its annual check or its hydrostatic test is out of service โ€” but it is still a sealed cylinder under pressure, often holding 100 psi or more. Putting one in a compactor or a scrap bin is how cylinders rupture. The disposal step is the part of the extinguisher lifecycle nobody writes a procedure for, which is exactly why failed units sit in the corner of maintenance rooms for years, occasionally getting picked back up and hung on a wall.

Why there is no single federal answer

People look for an EPA rule and do not find one, because of how the waste rules are structured. Waste generated by normal household activities is excluded from Subtitle C of RCRA โ€” the federal hazardous waste programme. It does not vanish from regulation, though: it is still governed under Subtitle D as solid waste, which is administered by states and municipalities. For pressurised containers specifically, EPA's guidance is to contact your local environmental, health or solid waste agency.

That means the correct answer genuinely varies by where you are, and any guide that states one nationwide procedure is overreaching. What does not vary is the physics: pressure has to come out before the shell becomes scrap.

One important distinction this guide will not blur. The household exclusion is for households. A business disposing of extinguishers is a commercial waste generator and is not covered by it. If you are clearing units from a facility, treat the waste determination as a question for your environmental contractor or your state agency โ€” not as something a buyer's guide can answer for you.

Step one: is it rechargeable or disposable?

This single question decides everything downstream, and the answer is stamped on the unit.

When an extinguisher genuinely reaches end of life

Three things retire a unit rather than merely flagging it for service:

  • It failed hydrostatic testing. Under OSHA's Table L-1, dry chemical extinguishers with mild steel shells are hydrostatically tested every 12 years; stainless steel shells every 5 years. A shell that fails is done โ€” it is not repairable.
  • It is a disposable unit that has been discharged, even partially. A partially used single-use extinguisher cannot be trusted to deliver its rated discharge.
  • The shell is corroded, dented at a weld, or the neck threads are damaged. Structural damage to a pressure vessel is not a service item.

Note what is not on that list: age alone. An extinguisher does not expire on a date the way a first aid item does. What ages out is the test interval and the condition, which is why OSHA 29 CFR 1910.157 fire extinguisher requirements is written around inspection and testing rather than expiry dates.

How to depressurise a disposable unit safely

  1. Confirm it is disposable, not rechargeable. Plastic valve, "do not recharge" wording. If in doubt, treat it as rechargeable and hand it to a servicing company.
  2. Take it outside, well away from doors, air intakes and drains. Dry chemical is an irritant and travels further than people expect.
  3. Wear eye protection and a dust-rated respirator. Discharging a dry chemical unit produces a dense cloud of fine powder โ€” this is the one genuinely hazardous step for the person doing it.
  4. Squeeze the handle until nothing more comes out, then wait, then squeeze again. Residual pressure is common after the first discharge stops.
  5. Verify the gauge reads zero and the unit feels weightless when shaken.
  6. Remove the head or leave the valve open so it is visibly depressurised โ€” this is what makes a scrap yard willing to take the shell.
  7. Then, and only then, follow your local authority's route โ€” household hazardous waste day, a scrap metal recycler, or a fire department programme where one exists.

Workplaces have an extra obligation

In an OSHA-regulated workplace, disposal is the tail end of a documented lifecycle, not an isolated errand. 1910.157 requires an annual maintenance check on portable extinguishers, and stored-pressure units do not require an internal examination as part of it. When a unit comes off the wall permanently, two things have to happen that a household never worries about:

  • Coverage does not lapse. The extinguisher was there to satisfy a travel-distance requirement. Removing it without replacing it creates a gap โ€” see fire extinguisher placement requirements.
  • The replacement has to match the hazard, not the old unit. 1910.157(d) requires extinguishers to be selected and distributed based on the classes of anticipated workplace fires and the size and degree of hazard. Worked example: clearing eight failed units from a plant

An annual inspection retires eight extinguishers: five rechargeable ABC units that failed hydrostatic testing at the 12-year interval, two disposable kitchen units that were partially discharged during a small incident, and one corroded unit from a wash-down area.

The five rechargeable shells and the corroded unit go back with the servicing contractor on the same visit โ€” they arrived with a truck, they are licensed to transport, and the failed shells become their problem rather than the plant's waste stream. The two disposable kitchen units are discharged outside by a maintenance technician wearing goggles and a particulate respirator, valves left open, then routed through the plant's normal scrap metal channel after the environmental contractor confirms that is acceptable in that state.

Coverage is re-established the same day. What not to do

  • Do not put a charged extinguisher in a bin, skip or compactor. It is a pressure vessel.
  • Do not puncture or drill a cylinder to relieve pressure.
  • Do not discharge one indoors "to empty it". Dry chemical fouls electronics and HVAC, and the cleanup costs more than the unit.
  • Do not assume the fire department takes them. Some do, many do not, and it is worth one phone call rather than an unannounced drop-off.
  • Do not keep a failed unit "as a spare". A unit that failed hydrostatic testing is not a backup; it is a hazard with a handle.

Frequently asked questions

Can you throw a fire extinguisher in the trash?

Not while it holds pressure. A charged extinguisher is a sealed pressure vessel and can rupture in a compactor. A fully discharged disposable unit with the valve open is a different proposition, but whether it can go in household waste depends on your local authority, because pressurised containers fall to state and municipal rules rather than a federal one.

Is a fire extinguisher hazardous waste?

For a household, waste from normal household activity is excluded from RCRA Subtitle C โ€” the federal hazardous waste programme โ€” and is instead regulated under Subtitle D as solid waste by states and municipalities. Scrap metal recyclers will generally take an extinguisher shell once it is provably empty and depressurised โ€” usually meaning the head removed or the valve left open so the inside is visible. They will typically refuse a sealed cylinder.

Is it safe to discharge an extinguisher myself?

For a small disposable unit, outdoors, with eye protection and a particulate respirator, it is a routine task. The hazard is the dust cloud rather than the fire risk. Do not do it indoors, near air intakes, or near drains.

What should I do with the dry chemical powder?

Sweep or vacuum it rather than washing it into a drain, and check the product's safety data sheet for its Section 13 disposal guidance. Note that OSHA does not enforce Section 13, so the operative instruction there comes from other agencies and from local rules.

Does removing an extinguisher from a wall create a compliance problem?

It can. The unit was almost certainly satisfying a travel-distance requirement, so pulling it without replacing it opens a coverage gap that an inspection will find.

Should the replacement be the same as the old unit?

Only if the hazard is unchanged. 1910.157(d) requires selection and distribution based on the classes of anticipated fires and the size and degree of hazard, so if the work in that area has changed, the rating and class should be reconsidered rather than matched to what was there before.

What about CO2 and clean agent extinguishers?

Can I keep an out-of-test extinguisher as a backup?

No. A unit that failed hydrostatic testing has a shell that is no longer trusted to hold pressure. Keeping it implies protection that does not exist.

Who is responsible for disposal in a workplace?

The employer, as part of the same lifecycle that covers placement, inspection and maintenance. In practice most facilities hand retired units back to the servicing contractor on the visit that condemned them, which is the cleanest route.
